Pool Safety Fence Requirements: Laws by State & What You Need
Drowning is the leading cause of accidental death in children ages 1–4. A proper pool barrier is the single most effective prevention measure — and in most states, it's the law. Here's what the requirements actually look like.
The Federal Baseline: Virginia Graeme Baker Act
Federal law (the VGB Act, 2008) requires anti-entrapment drain covers on all public and commercial pools and spas. It doesn't directly mandate residential fencing, but it established a framework for state and local codes to build on. Most residential fence requirements come from state or county law.
The ASTM / Model Barrier Standard
Most state codes are based on ASTM F2286 or the International Swimming Pool and Spa Code (ISPSC). The core requirements:
- Height: Minimum 48 inches (4 feet). Many states require 5 or 6 feet, especially if the fence is climbable.
- Openings: No opening larger than 4 inches — a 4-inch sphere shouldn't pass through.

Florida: Residential pools require a 4-foot barrier. Can use the house as a wall if exit doors have alarms or self-closing/latching hardware. Florida also requires pool alarms or safety covers as an alternative barrier (one of four approved "layers" required).

New York: 4-foot minimum, but local codes typically require more. Nassau County requires 5-foot fences; NYC has its own regulations. Always check local code on top of state law.
Illinois: 42-inch minimum statewide, but Chicago and suburban Cook County require 5 feet. Illinois allows the home to serve as a barrier side under specific door conditions.
What Does Not Count as a Barrier
- Pool covers alone (even motorized safety covers don't replace fencing in most states)
- Landscaping, hedges, or bushes
- Decorative wrought iron with horizontal bars (climbable)
- Chain-link without a mesh liner on the lower section
Costs to Expect
